Arena Solutions, Inc. (“Arena”) created the Arena Forums to
provide an open area for users of Arena SaaS services and applications
(“Users”) to share information, experiences, and advice with one another.
These Terms of Use (“Terms of Use”), Code of Conduct (http://forums.arenasolutions.com/index.php?act=boardrules),
and the Arena Solutions Privacy Policy (http://www.arenasolutions.com/footer/privacy.html)
govern your use of the Arena Forums. These terms are not exhaustive and Arena
reserves the right to modify them at any time, effective upon posting. By
registering as a User or by using the Arena Forums, you agree to abide by these
terms. The Arena Forums are a valuable place for people to exchange information
and ideas and learn from one another. Like any community, the Arena Forums are
most valuable when everyone follows certain basic guidelines and rules of
conduct. These Terms of Use and the Code of Conduct detail what is expected of
you and what you can expect from other Users when using the Arena Forums. Arena
is an English language forum, and use of Arena Forums is governed by U.S. law.
Arena encourages open dialogue in the Arena Forums, within the
guidelines set forth in these Terms of Use. Specifically, you agree not to
upload, post, publish, transmit, or reproduce:
Arena employees (“Employees”) will serve as Administrators of the Arena
Forums and retain the right to remove or correct any posting that violates the
Terms of Use, at their discretion. All postings made by Users other than
Employees express the views of the author and Arena shall not be held
responsible in whole or in part for the content of such postings.
As an Arena Forums User, you grant to Arena and its designees a
perpetual, irrevocable, non-exclusive fully-paid up and royalty free license to
use any ideas, expression of ideas or other materials you submit (collectively,
“Materials”) to the Arena Forums without restrictions of any kind and without
any payment or other consideration of any kind, or permission or notification,
to you or any third party. The license shall include, without limitation, the
irrevocable right to reproduce, prepare derivative works, combine with other
works, alter, translate, distribute copies, display, perform, license the Materials,
and all rights therein, in the name of Arena, or its designees throughout the
universe in perpetuity in any and all media now or hereafter known.
Arena may also post official documents regarding our applications
from time to time. These documents may include, but are not limited to, the
contents of previous newsletters, usage tips, and upcoming events. Unless
specifically noted otherwise, the Arena Forums will not be, nor should be
construed as, the primary source of such documents and announcements. Any
official documents and announcements affecting your relationship with Arena and
our services will always be delivered primarily via the SaaS application or by
phone, mail, or e-mail directly from Arena.
While Employees may choose to respond to postings containing
questions about various aspects of our applications, the Arena Forums are not an
area for Users to solicit and expect responses from Arena. Messages addressed
to specific individuals at Arena, including company executives, may not be
answered. Please continue to contact the Arena Customer Support Team for all
such inquiries.
Most of the content posted to Arena Forums will be provided by
Users. Such third-party content is the sole responsibility of the person
originating that content. Arena does not control, and is not responsible for
this third-party content. Arena does not warrant or guarantee the accuracy,
reliability, completeness, usefulness, non-infringement of intellectual
property rights, or quality of any content on Arena Forums regardless of who
originates that content. As an Arena Forums User, you expressly understand and
agree that you bear all risks associated with using or relying on that content.
Arena will not be liable or responsible in any way for any content posted on or
linked from Arena Forums including, but not limited to, any errors or omissions
in content, or for any losses or damage of any kind incurred as a result of the
use of or reliance on any content.
If at any time you do not agree with the Arena Forums Terms of Use
set forth here, please refrain from further use of the Arena Forums.
Arena reserves the right to cancel the Arena Forums membership of
Users violating these Terms of Use with or without notification. Arena also
reserves the right, in our sole discretion, to terminate your Arena Forums
membership, for any reason, with or without notice. Arena also reserves the
right to cancel the Arena Forums membership of Users who have not logged in to
the Arena Forums in the preceding 90 days.
Arena reserves the right to remove content that is outdated,
violates the Terms of Use, or for any other reason deemed necessary.
Arena reserves the right at its discretion to change these Terms of Use and its policies relating to the Arena Forums at any time and shall notify you by posting an updated version of these Terms of Use on the Arena Forums. You are responsible for regularly reviewing these Terms of Use. Continued use of the Arena Forums after any such changes shall constitute your consent to such changes.
